Nick Johnson of Johnson Law Group, with principal offices in Houston, Texas, is urging the families and victims of nursing home abuse to fight back despite the increased regulations imposed by many states limiting nursing abuse lawsuits. "Many states are making it more difficult to sue and get monetary awards for damages from nursing homes," says Johnson. "As a result, fewer lawsuits are being filed and, not surprisingly, less is being done to correct the mistreatment of the clientele at the homes." Many states have passed lawsuit "caps" that severely limit the amount of monetary damages that may be collected. The nursing homes claim that this helps them to better predict their costs with regard to liability-insurance premiums. However, the caps make it more difficult for victims to find a lawyer willing to take the financial risk of representing them. In addition, many of the larger nursing home chains are breaking themselves into pieces called "single-purpose entities" therefore restructuring their businesses, which insulates them from liability. The concern of Johnson and others is that without the proper imposed punishment, the crime may be all but forgotten. yup , me , my hub on nursing home abuse and politics tells the story of my mother and father in law in florida , I did get an attorney in Houston , who farmed it out to a attorney in Florida , who , because of who the guy is who owns the nursing home , lied to the attorney in houston and subsiquently , it got declined , even with the picture of the bedsore , ya gotta read my hub to understand , lawyers dont always work , I told the guy in houston it was political , but what more can i do ?
